GUWAHATI: Following a Public Interest Litigation (PIL) filed in Arunachal Pradesh, a bench of the Gauhati Hich Court pulled up the state government for the current condition of the state's Human Rights Commission.
Tarah Gambo had filed a PIL with the Gauhati High Court seeking action on the functioning of the human rights commission in the state. The PIL mentioned that the commission was now performing as it should have because there is only one chairperson.
Mentioning the 'improper functioning ' of the commission, the High Court ordered the state government to file an affidavit before the court mentioning the steps taken by the state to fill the vacant positions with the Arunachal Pradesh Human Rights Commission. A deadline of December 16 has also been issued by the High Court.
The Itanagar Bench of the Gauhati High Court held a hearing of this PIL and issued a notice to the Government of Arunachal Pradesh. The Bench tho heard the petition, consisted of Justice Kalyan Rai Surana and Justice Mitali Thakuria.
The special bench of the High Court mentioned that, "Having taken note of the fact that by virtue of notification issued on January 24, 2020, the former judge of this court was appointed as the chairperson of the Arunachal Pradesh Human Rights Commission, but the commission itself has remained a non-starter because both the posts of members have remained vacant.
Moreover, no permanent staff including driver, peon and other support staff of the commission and for its chairperson have been appointed so far."
After hearing the comments given by all the parties mentioned in the litigation, the special bench issued a notice to the chief secretary of Arunachal Pradesh to file an affidavit disclosing the steps taken by the government towards the appointment of the two members of the commission and other office staff including driver and peon or support staff for the chairperson. The order also directed them to disclose the time frame within which the recruitment process would be completed.
